Terms of use.

1. Who we are

These Terms govern your access to and use of Product Leader / productleader.cv (the "Service"), operated by Loistava Holding UG (haftungsbeschränkt), Asternring 9, 15732 Schulzendorf, Germany, registered with the Amtsgericht Charlottenburg Berlin under HRB 157120 B ("Loistava", "we", "us", "our").

2. What we do

We provide tools for product managers to build a public professional profile and portfolio, generate a first-draft portfolio from a resume, and (if selected) access curated learning content and job opportunities. Free and paid tiers are available.

3. Acceptance of these Terms

By creating an account, using, or accessing the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity.

4. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You may not use the Service if you are barred under applicable law or any sanctions program.

5. Account registration and security

Provide accurate information and keep it updated. You are responsible for your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

6. User Content & licenses

6.1 Your content

You retain ownership of text, images, links, and other materials you upload or publish in your portfolio ("User Content").

6.2 License to us

Solely to operate and improve the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (e.g., for formatting), publicly display and distribute your User Content, including to make it viewable where you publish your portfolio or share links. This license ends when your content is deleted from our systems (subject to reasonable backup/archival limits).

6.3 Your responsibilities

You are solely responsible for User Content and represent that you have all rights necessary to grant the above license and that your content does not infringe rights or laws (including NDAs—see §6.5).

6.4 Public portfolios

If you set your portfolio to public, its contents may be indexed by search engines and viewed by anyone with the link.

6.5 NDA/Confidential information

Do not upload trade secrets or confidential data. If your work is under NDA, obfuscate/anonymize details (e.g., "improved conversion by 15% for a Fortune 500 client").

6.6 Feedback

If you submit ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

7. Acceptable use

You agree not to: (a) violate laws or third-party rights (privacy, IP, publicity); (b) upload malicious code; (c) bypass measures to protect the Service; (d) scrape, bulk-harvest, or perform rate-limited automated access except as allowed by robots.txt or a written agreement; (e) misrepresent your identity or affiliation; (f) post unlawful, defamatory, obscene, hateful, or deceptive content; (g) reverse engineer or use the Service to build a competing product.

8. Intellectual property of the Service

The Service, including software, design, and trademarks (e.g., Product Leader / productleader.cv), is owned by Loistava or its licensors and is protected by IP laws. Except for limited rights to use the Service, no licenses are granted.

9. Plans, pricing, payments, renewals, and taxes

9.1 Plans

We offer a free plan and paid features (e.g., "Comprehensive Portfolio"). Current prices are shown in the product interface and may change prospectively.

9.2 Subscriptions & renewal

Paid plans are subscriptions that auto-renew for the billing period shown at signup unless cancelled before renewal.

9.3 Billing

You authorize us and our payment processors to charge your payment method for all fees due, including applicable VAT/sales taxes. If your payment fails, we may suspend or downgrade your account.

9.4 Refunds & EU withdrawal right

If you are an EU consumer, you have a 14-day right of withdrawal for distance contracts. By purchasing digital services that begin immediately, you expressly request early performance and acknowledge that your withdrawal right may partially or fully lapse once services are fully performed. We may, at our discretion, offer pro-rata refunds for unused time where required by law.

9.5 Price changes

We'll provide notice of price changes; continued use after the change takes effect means acceptance.

10. Third-party services

The Service may link to or integrate third-party tools (e.g., payment processors, analytics, hosting, job sources). We are not responsible for third-party terms or content; your use of them is at your own risk.

11. AI-assisted features

Where the Service offers AI-assisted drafting (e.g., portfolio draft from resume), you remain responsible for reviewing, editing, and ensuring accuracy and legality of any outputs. Do not input sensitive personal data unless necessary and you understand the risks.

12. Changes to the Service

We may modify, suspend, or discontinue features with reasonable notice where feasible. If we materially discontinue a paid feature mid-term, we'll provide an appropriate remedy (e.g., pro-rata credit/refund) where required by law.

13. Termination

You may stop using the Service anytime and cancel auto-renew in your account settings or by contacting support. We may terminate or suspend your account for material breach (e.g., illegal content, non-payment), with notice where appropriate. Upon termination, your license to use the Service ends and we may delete your content per our retention practices.

14. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied (merchantability, fitness, non-infringement, accuracy, availability). This does not affect statutory consumer rights.

15. Limitation of liability

To the extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) €50 or (b) the amounts paid by you to us in the 12 months before the claim. We are not liable for indirect, special, incidental, exemplary, or consequential damages, loss of profits, data, or goodwill. Nothing excludes liability for intent, gross negligence, injury to life/body/health, or under product liability laws.

16. Indemnity

You will indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your User Content or your breach of these Terms.

17. Governing law & venue

These Terms are governed by the laws of Germany, excluding conflict-of-laws rules and the UN CISG. If you are a consumer with habitual residence in the EU/EEA/UK, you also enjoy the protection of mandatory provisions of your local law. Exclusive venue is Berlin, Germany, except where consumer law provides otherwise.

18. Consumer dispute resolution

We are not obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Mandatory EU ODR information will be provided where required.

19. Changes to these Terms

We may update these Terms. If changes are material, we will provide reasonable notice (e.g., in-app notice or email). Your continued use after the effective date constitutes acceptance.
